JUDGES’ CONSIDERATIONS IN IMPOSING CRIMINAL SANCTIONS FOR AGGRAVATED THEFT COMMITTED BY CHILDREN (A Study at the Raba Bima District Court)

Abstract

This study aims to determine the application of criminal sanctions against criminal acts of theft by weighting done by children in the Raba Bima District Court decision and how judges consider in imposing criminal sanctions against children. This research was conducted at the Raba Bima District Court by conducting direct interviews with the judge who decided the case of theft with a weighting by the child and accompanied by taking a copy of the decision related to the research. In addition, researchers also conduct literature studies by examining books, literature and laws and regulations relating to issues to be discussed in writing. Obtained from this research, the judge's consideration in imposing criminal sanctions on children who commit a criminal act of theft with weighting in the Raba Bima District Court is based on evidence, namely the testimony of witnesses and statements of the defendant accompanied by evidence submitted by the public prosecutor as well as facts. which was revealed in the trial. In addition, the criminal sanctions given are not aimed at destroying the future of a child who has committed the criminal act of thieving by weighting, but to provide a deterrent effect so that the child does not repeat the act, and to make the child better and beneficial to the country and the nation.
