Abstract

Summoning witnesses using summons in the criminal justice system is a must, therefore it is important for law enforcers to summon witnesses with letters regardless of the conditions. A summons is a right for citizens to know what to say in the examination of a criminal case, because in the summons there is some information that can be read, namely when, in what case, and as what was summoned. If the summons is not submitted, it will automatically take the rights and a witness. The problem with summoning witnesses without a summons occurs because of several factors, including the cases being handled are a disgrace in the community, the witnesses’ identities are not complete, the witnesses come directly on their own initiative, the perpetrators are people closest to the victims, and the lack of awareness and knowledge of the law. As a result of summoning witnesses without a letter, it can result in the absence of legal certainty for the witnesses who are summoned and can result in null and void, even if the investigator who makes the summons has violated the code of ethics of the investigation which results in the investigator being reported and subject to sanctions.
